Trusts can sometimes be overlooked as an option for lifetime planning and their uses within estates, however when prepared properly these can be great tools in a practitioner’s armoury to ensure that a client’s needs are met.
Problems can arise however if the trust is not drafted properly, and this has led to cases where the objectives of the trust may not be met, or beneficiaries have lost out.
Tax complications can also cause problems and full advice and careful drafting should be done at the start to ensure the objectives of the trust are being met.

I am a solicitor and Trusts and Estates Practitioner. Since qualifying in 2009, I have specialised in Wills, Probate, Trusts, Tax and Court of Protection matters, and I am a Dementia Champion with Age UK, a member if the Later Life Lawyers and also a member of STEP (The Society of Trusts and Estates Practitioners).
I am a member of the Wills and Equity Committee for the Law Society, which advises the Law Society on matters relating to the reform of the law and the legislative process relating to wills, probate, financial and tax planning, trusts and estate administration and, insofar as it relates to such matters, the law relating to mental capacity and charities. It also supports the development of up to date professional advice and guidance on such matters, and reviews and advises on the role, design and operation of relevant accreditation schemes liaises with the Law Society’s Private Client Section.
My other work includes seminars, lecturing and training throughout the Country with institutions such as regional Law Societies and MBL Seminars Limited, as well as providing in house training on a number of subjects. I am also an author for Tolleys.
In addition, I also teach night classes at Rossett School Adult Learning in Harrogate, giving individuals and insight into how legal documents such as Lasting Powers of Attorney are drafted, as well as pitfalls and problems.
