- Demonstrate an understanding of the Mental Capacity Act 2005 and the legal framework, including: – the statutory principles, – definition of mental capacity, – the test for capacity.
- Demonstrate an understanding of when to consider a client’s mental capacity and the illnesses which may affect decision making.
- Apply the test of capacity.
- Demonstrate an understanding of capacity to instruct a practitioner.
- Identify, through the use of practical examples, how to determine a lack of mental capacity.
- Work out what to include in your file and attendance notes.
Identify when to instruct an expert to undertake a mental capacity assessment.

Now a Consultant Solicitor at Richard Nelson Solicitors, he provides training to legal professionals, estate planners, firms and their teams across all areas of Private Client Law, including Wills, Probate, Tax, Trusts, the Court of Protection and Care Funding, alongside skills‑based training. He is also a Visiting Lecturer at the University of Law, based at the Bloomsbury Campus in London.
Scott has worked in the Wills and Probate field since 2007 and qualified as a solicitor in 2013. He is also a Professional Member of the Professional Speaking Association.
