In this miniseries, you will learn how to draft LPAs that demonstrate real value to your clients. We will seek to overcome some of the common challenges that we face when advising clients about LPAs, so that our client will see us as their trusted advisor, recommend us and instruct us time and time again.
By the end of the sessions, you will be able to:
- Identify what instructions to take from clients to effectively draft their LPAs
- Apply the test of Mental Capacity to make LPAs
- Write instructions and preferences in an LPA, including some common clauses and challenges
- Demonstrate an understanding of Business LPAs and when they are needed
- Build an understanding of Health and Welfare decisions
- Interpret the differences between advanced decisions and a health and welfare LPA
- Understand how advanced decisions and health and welfare LPAs interact and which is best to use
- Identify what information and advice to give to attorneys
- Navigate the changes to LPAs under the Powers of Attorney Act 2023

Scott Walker – Consultant Private Client Solicitor at Richard Nelson LLP
Scott is a solicitor and Visiting Lecturer at the University of Law specialising in Wills, Probate, Trusts, Tax, Court of Protection and Vulnerable Client matters. He has been involved in the area of Wills and Probate since 2007 and qualified as a solicitor in 2013. He is also a full accredited member of Solicitors for the Elderly (currently rebranding to the Association of Lifetime Lawyers) as well as an Associate Member of the Professional Speaking Association.
