The use of and issues arising as to the enforceability of restrictive covenants are becoming important factors  for landowners particularly given the relaxation of planning rules. As a result it is even more important for conveyancers to appreciate how to draft and advise on restrictive covenants and to ensure appropriate advice is given to clients where land being acquired is either burdened by or benefits from restrictive covenants.
